These lands in the traditional village awig-awig are called druwe desa which consist of laba pura land, field land, market land, setra land, bukit land, AYDS land, PKD land. Most of the druwe land in this village has been converted into full individual land through conversion according to the UUPA. One of the criteria for the existence of a traditional village can be measured by the sustainability of this druwe desa land as one of the village assets, both as material and immaterial assets. The conversion of druwe desa land often causes prolonged conflicts due to late awareness of the importance of preserving village druwe land. The potential of the druwe desa land when explored and adapted to the development of tourism in Bali can be a bonus for the village government and its krama desa (village residents) in achieving prosperity. To achieve this goal requires high awareness and commitment from krama desa, village government (custom and service), local government and government through policies in growing a culture of village manners in order to maintain the realization of the Tri Hitakarana philosophy in traditional villages which is used as an advantage for sustainable investment and as well as in strengthening the existence of traditional villages.","PeriodicalId":150931,"journal":{"name":"Community Service Journal of Law","volume":"362 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2022-01-31","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"127977820","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

In the land sale and purchase agreement made before a notary, the seller has an obligation to provide honest information about the condition of the land to be sold and nothing is covered up. Likewise, the buyer must check the location of the land to be purchased carefully, to find out in advance whether the purchased land can be built or not. This study will examine and analyze the principle of good faith in legal provisions, especially in contract law. Good faith is still often a matter of debate, because there are still many parties who enter into an agreement who are dragged into legal problems in court, including those with good intentions. Good faith must exist from the pre-contract where the parties start negotiating until reaching an agreement until the contract implementation phase. This research will examine the problems: Is the good faith in the sale and purchase agreement of land rights made before a Notary obliged to accommodate the principles of rationality and propriety? This research uses normative legal research, namely by using primary legal materials and secondary legal materials, then the approach used is the approach to legislation, concepts and philosophy, legal history and comparative law approach. The findings in this study are good faith in a sale and purchase agreement of land rights based on the contents of the agreement containing the principles of rationality and propriety. The context of good faith in Article 1338 paragraph (3) of the Civil Code is based on rationality and propriety. The standard used in assessing good faith in the implementation of the contract is an objective standard. With this standard, the behavior of the parties in carrying out the contract and the assessment of the contents of the contract are based on the principles of rationality and propriety. Good faith has a very important role in making an agreement, including in the sale and purchase agreement of land rights made before a notary in order to minimize the possibility of fraudulent practices in the sale and purchase transaction.","PeriodicalId":150931,"journal":{"name":"Community Service Journal of Law","volume":"71 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2022-01-31","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"115957986","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The Apuan Village Government has received assistance from the Bangli Regency Government in the context of the construction of drinking water supply facilities which in its management are handed over to Apuan Village. In its development, the distribution of drinking water in Apuan Village has not been able to reach the entire community of Apuan Village, so a drinking water facility development program is needed. However, the program is constrained in terms of authority and funding. In fact, the results of the management of water sources for drinking water which are handled by Apuan Village, are fully intended for the benefit of the village community, so there is no availability of funds to support the program plan for the development of drinking water management facilities. The Apuan Village Government does not have the authority to carry out the water management development program, considering that there is no legal umbrella for the Apuan Village Government to run the drinking water management development program in Apuan Village. In the distribution of legal aid, the idea of a village paralegal was born. One of the ways to fulfill this access to justice is by optimizing the role of paralegals at the village level. Village paralegals are expected to help the community in the village understand the law. In this study, two problems were discussed, namely regarding the position of paralegals in fulfilling the right to legal aid and the function of village paralegals in solving legal problems. The provision of legal aid aims to provide access to justice, equity and fulfillment of civil rights and political rights of all people. Paralegals have the task of providing legal assistance to the poor as a form of service for the poor who need assistance in obtaining their legal rights. The formation of village paralegals is very important to overcome legal problems that exist at the village level. Handling conflict in the village is not enough with a social and cultural approach but also with a legal approach.","PeriodicalId":150931,"journal":{"name":"Community Service Journal of Law","volume":"54 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2022-01-31","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"120945618","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
