This reflexivity is fundamental to overcoming various regulatory hurdles posed by complex and dynamic sustainability challenges, such as plastics circularity. However, even when European Union (EU) environmental legislation incorporates REL techniques, Member State transposition may either undermine or enhance these techniques' potential for driving regulatee reflexivity. This article examines REL's evolution within complex, transnational legislative frameworks, taking the EU's Single‐use Plastics Directive (SUPD) as a case study. It compares reflexivity techniques in the SUPD to those in transpositions by France and Germany. Our analysis is based on the coding of 11 REL techniques and three overarching reflexive drivers—autonomy, accountability and adjustability—within four SUPD instruments. This article discusses the potential coupling of energy communities and district heating and cooling systems, particularly fourth‐ and fifth‐generation models, in the local energy transition. The integration of new‐generation district heating and cooling systems into renewable energy generation is crucial for sustainability, circular economy practices, and community‐based solutions. An examination of the EU legal framework within the Fit‐for‐55 package elucidates how provisions from the new Energy Efficiency Directive and Renewable Energy Directive facilitate the implementation of energy communities in the heating and cooling sector. {"title":"Reassessing environmental protection in international investment agreements: The case of Vietnam","authors":"Tien Dat Hoang","doi":"10.1111/reel.12555","DOIUrl":"https://doi.org/10.1111/reel.12555","url":null,"abstract":"The proliferation of international investment agreements reflects the tireless efforts of many governments in the world to attract foreign investment and significantly improve their investment environment, including Vietnam. However, investment overshielding without regard to public policy objectives also has negative consequences, such as indirectly and directly causing environmental pollution at investment sites. Vedan Vietnam and Formosa Ha Tinh Steel are prime examples of ecological incidents with long‐term damage to the host State. Using critical and case study approaches, this article examines the reasons behind those incidents and analyses Vietnam's improper response to the cases. More importantly, the article criticises the lack of alignment of the domestic legal system and international investment law. We start by identifying the conventional forms of knowledge that serve as inputs into that co‐productive process, namely scientific, societal and legal knowledge. We show that sustainability‐related propositions have gained considerable traction in the regulation of genetic modification (GM) in the EU. Furthermore, the analysis reveals that sustainability cannot be reduced to scientific or societal knowledge. As far as the overlap between sustainability knowledge and legal knowledge is concerned, it is undeniable that sustainable development is deeply embedded into EU regulation; however, treating sustainable development solely as an element of the law does not capture the material influence that it exerts on society and technology, not to speak of its evolutionary flexibility. The United Nations Framework Convention on Climate Change (UNFCCC) and its Technology Mechanism have largely overlooked the importance of localisation and have created a governance environment that neither reflects the ‘messiness’ of this process, nor the need for flexibility and long‐term collaboration for effective search and discovery, implementation and knowledge creation. This article focuses on the Climate Technology Centre and Network (CTCN), the Technology Mechanism's implementation arm, and the challenges it faces in orchestrating the transfer of technology to the Global South. Drawing on recent empirical research and theories of innovation and experimentalism, the article examines how the CTCN and its associated institutions could be governed in ways that better enable localisation. The EU's regulatory project implicitly qualifies data as an infrastructure for a better economy and society. However, current EU law does not draw all the logical consequences derived from this qualification of data as infrastructure, which is one main reason why EU data legislation for the ecological transition may not deliver on its high political expectations. The ecological transition does not play a significant normative role in EU data legislation and is largely overlooked in the data governance literature.
