Note that efficiency in this sense (called “Kaldor-Hicks” efficiency) does not require that costs be allocated justly between people. Justice, from the economists’ perspective, is a separate ideal. Some economists (not all) have argued that justice is a confused, contestable idea, and that society would be better off if tort rules were fashioned solely to advance efficiency.","PeriodicalId":135727,"journal":{"name":"Law and Economics for Civil Law Systems","volume":"17 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"1900-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"122345166","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
