{"title":"The Female Poisoner’s Fate: Accounting for Lenient Outcomes in New South Wales, Australia, 1855-1955","authors":"Carolyn Strange","doi":"10.4000/chs.3424","DOIUrl":"https://doi.org/10.4000/chs.3424","url":null,"abstract":"Most scholarly histories of the female poisoner use high-profile cases to explore the cultural, social, political and legal construction and repercussions of women’s poisoning crimes. Yet, the study of notorious poisoners has obscured how most women tried for poisoning were treated by the courts. By deploying a longitudinal analysis of women prosecuted for murder or attempted murder by poisoning, this article challenges the feminist historiographical and criminological consensus that women poisoners are invariably demonised by the press and subjected to harsh penalties by the courts. It examines the former penal colony of New South Wales, Australia, from the mid-1800s to the mid-1950s, over which time 47 women were prosecuted and just one was executed. Through four case studies, it illustrates the prosecution outcomes that befell most women tried for poisoning. This lenience cannot be attributed solely to the race, ethnicity, class, and sexual respectability of women on trial for poisoning. Analysing the female poisoner’s fate must also take into consideration victim-offender relationships, the purported motives of accused women, the nature of specific poisons, the statutory framing of poisoning, and the shifting context of penal politics.","PeriodicalId":121298,"journal":{"name":"Crime, history and societies","volume":"34 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-10-27","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"136234076","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Après avoir montré que les prisonniers et les prisonnières appartiennent aux classes populaires défavorisées de l’Aisne, l’article s’attache à décrire les clivages qui structurent la population pénitentiaire laonnoise. À un groupe particulièrement désaffilié s’oppose un ensemble d’individus pouvant témoigner de gages d’insertion sociale. Ces distinctions socio-pénales permettent, dans un second temps, d’éclairer les différentes voies qui mènent aux portes de la prison de Laon. Quatre types d’entrée sont distingués, en fonction de la vitesse d’exécution des décisions judiciaires et de la présence ou non d’un agent des forces de l’ordre. La détention préventive, la coercition rapide, la coercition retardée et la constitution volontaire dessinent une gamme élargie de l’expérience du pouvoir de l’État dans la France du premier XXe siècle. Loin de se réduire à l’application mécanique d’une procédure, l’incarcération apparaît comme une pratique sociale qui n’offre pas les mêmes marges de manœuvre à tous les individus.","PeriodicalId":121298,"journal":{"name":"Crime, history and societies","volume":"70 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-10-27","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"136234075","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Tepperman","doi":"10.4000/CHS.2804","DOIUrl":"https://doi.org/10.4000/CHS.2804","url":null,"abstract":"Historical accounts of prison uprisings within the United States have overwhelmingly situated the origins of incarcerated people’s large-scale, organized rebellions in the mid-twentieth century. The literature most often presents World War Two as an epochal moment that created the preconditions for modern activism within prisons. This article employs a content analysis of 44,000 interwar-era (1919-1941) newspaper stories of prison unrest to show that pre-war levels of radical rebellion in the United States were comparable to post-war levels. This finding suggests a certain continuity in penal radicalism over the twentieth century and undermines the notion that the effects of World War Two were necessary preconditions to the creation of a national political identity among incarcerated Americans.","PeriodicalId":121298,"journal":{"name":"Crime, history and societies","volume":"34 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2020-12-22","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"115026172","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

A chaque prisonniere sa facon de s’en accommoder, entre adaptations et transgressions. Les sociabilites multiples et changeantes qui en decoulent, entre codetenues, avec le personnel et les proches, inflechissent le quotidien des captives, leur vecu de l’incarceration et leur apprehension de la liberation. It investigates how juries judged criminal behaviours committed in the intimate world of domestic life, with special attention to murder trials, infanticide cases, incestuous relationships and sexual offences. The Giudecca section of the Venetian State Archive preserves the judicial records of the proceedings held at the court of Assize of Venice from 1871 to 1898, bringing to light fragments of human stories, to date almost completely ignored by research. Jurors’ deliberations in this kind of situations move from leniency to severity depending on the circumstances of the case, leading sometimes to unexpected results.","PeriodicalId":121298,"journal":{"name":"Crime, history and societies","volume":"8 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2020-12-22","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"125323215","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
