For over 60 years, legal standards specified that unpaid internships at for-profit employers had to be part of a prescribed educational or training course with no displacement of regular employees and no immediate employer advantage. The longstanding approach has been superseded since 2010 by a judicial balancing test, asking whether employer or unpaid intern is the “primary beneficiary†. This newly created test has made it easy for employers to justify unpaid internships. The asserted policy benefits derived from internships (resume enhancement, networking opportunities, training received) are realized to a greater degree by paid rather than unpaid interns. And any benefits are outweighed by lack of protection under anti-discrimination laws for these “non-employees†; the disparate impact of access to unpaid internships based on family wealth; and employers’ ability to substitute unpaid interns for regular employees receiving decent wages.","PeriodicalId":111145,"journal":{"name":"Internships, Employability and the Search for Decent Work Experience","volume":"19 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-06-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"115112939","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The role of work experience and, more specifically, internships during higher education (HE) in facilitating access to work and enhancing labour-market outcomes has been debated in academic and policy literature.2 For HE students, internships are widely considered a way of accessing work experience and on-the-job training, and are assumed to enhance their labour-market outcomes, in particular at the early career stage.","PeriodicalId":111145,"journal":{"name":"Internships, Employability and the Search for Decent Work Experience","volume":"19 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-06-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"116038003","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

It explores what is known about their prevalence, in particular from large-scale surveys in Europe and Australia. It also highlights four persistent policy concerns that emerge from the literature on internships: whether they deliver quality training; whether they provide a bridge from education to paid work, as they are often promised to do; whether unpaid or low-paid internships impede social mobility; and whether such arrangements may be displacing paid employment and undermining labour standards.","PeriodicalId":111145,"journal":{"name":"Internships, Employability and the Search for Decent Work Experience","volume":"12 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-06-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"130213474","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

While an extension of social security rights of employees can be observed, the regulation creates situations of segmentation, both among trainees and between trainees and employees. Being paid an allowance of a certain level generally appears to be a decisive factor, which highlights the importance of paid traineeships. Moreover, when there is extension, it does not operate for all social risks, particularly not unemployment. And while traineeships play an important role in EU youth employment policy, EU instruments, like the Quality Framework for Traineeships, do not address those questions adequately. This is to be lamented, as those regulative problems could be considered as contributing to a phenomenon of systemic discrimination against young workers.","PeriodicalId":111145,"journal":{"name":"Internships, Employability and the Search for Decent Work Experience","volume":"45 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-06-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"124560343","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Yet too little is known as to their effectiveness in providing a bridge to longer-term employment. Previous studies have repeatedly found a strong positive association between interns being paid and their post-programme labour market integration. However, convincing evidence is lacking on the causal mechanisms underlying this association. Data from two international surveys allow us to investigate the source of the differential impact of paid vs. unpaid internships. Our analysis of the first survey data confirms the existence of a robust positive association between the payment of interns and beneficial post-internship outcomes. The second allows us to go one step further and identify some of the specific characteristics underlying `successful' internships. In particular, we find that internships that are structured, last at least six months, involve a mentor and provide health insurance produce better post-internship outcomes than those lacking these features.","PeriodicalId":111145,"journal":{"name":"Internships, Employability and the Search for Decent Work Experience","volume":"46 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-06-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"129525101","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

However, concerns have arisen across the globe about whether these arrangements provide interns with appropriate workplace rights and protections and whether they adequately ensure a high quality training experience. This chapter provides an analysis of the range of approaches to the regulation of ALMP internships in seven countries: Argentina, Australia, Canada, China, Germany, South Africa and the United States. In particular, the chapter explores the extent to which these countries regulate ALMP internships for the purposes of their labour, anti-discrimination, occupational health and safety, and workers compensation standards, before turning to examine the regulation of the quality aspect of these arrangements. The chapter concludes by considering some minimum expectations and principles which should guide the design of laws that regulate ALMP internships.","PeriodicalId":111145,"journal":{"name":"Internships, Employability and the Search for Decent Work Experience","volume":"13 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-06-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"131303265","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
