O sistema híbrido de tratamento de controvérsias pode ser propiciado a partir da cláusula mista e escalonada (multietapas), prevista nos contratos. As cláusulas escalonadas oferecem um amplo tratamento a causas com alta complexidade que surgem ao longo da execução de contratos empresariais, viabilizando uma maior autonomia da vontade na tomada de decisão em meio a controvérsias e, assim, a manutenção do relacionamento a longo prazo, com maior adequação às reais necessidades e interesses dos envolvidos. Os benefícios da mediação no procedimento arbitral configuram-se, ainda, na celeridade do procedimento e redução de custos financeiros, quando adotadas as cautelas necessárias à previsão do sistema híbrido. A mediação tem se caracterizado como um meio de transformação e, assim, manutenção das relações de longa duração, sendo eficaz em contratos de negócios.","PeriodicalId":101933,"journal":{"name":"REVISTA BRASILEIRA DE ALTERNATIVE DISPUTE RESOLUTION","volume":"68 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-12-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"127095517","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

A relevância do tema reside no fato de a eleição da via arbitral não ser, sozinha, suficiente para garantir a segurança jurídica necessária à celebração de contratos administrativos com o parceiro privado. Inicialmente, serão analisadas as possibilidades de pagamento pela via administrativa e por intermédio de fundo garantidor de natureza privada e patrimônio próprio. Na sequência, será avaliada a possibilidade de compensação de créditos recíprocos entre o particular e o ente administrativo, por decisão do tribunal arbitral, na forma do Código Civil, como alternativa complementar.","PeriodicalId":101933,"journal":{"name":"REVISTA BRASILEIRA DE ALTERNATIVE DISPUTE RESOLUTION","volume":"106 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-12-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"124912053","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

It has altered the conduct of arbitration by changing the way disputants communicate. Being the modern tool for communication, it has elevated the speed and dissemination of information, which allows audiences to follow the dispute and express their support or dissatisfaction towards the disputants. As a consequence, the parties seeking redressal of their grievances through ADR get influenced due to the formation of ‘unconscious bias’. Communication is the epitome of the dispute resolution process, and the intervention of social media in the process generates a ghost syndrome, thus, resulting in the fading of such epitome. Its impact is not restricted to the parties but has the potential to undermine the independence, integrity, and impartiality of the judge or the mediator. Social Media has become significant within the legal domain as technology penetrates all ambits of individual endeavors. Looking towards the positive contributions, it acts as a source of evidence, especially in employment and labor disputes. Transformations in communication technologies have altered the definition of power in international arbitration, the class of individuals participating in the process, and strategies employed to mediate the conflict. The paper intends to discuss the elite usage and manipulation of social media impacting ADR, the cases influenced by it, and the theoretical framework required for its conduct.","PeriodicalId":101933,"journal":{"name":"REVISTA BRASILEIRA DE ALTERNATIVE DISPUTE RESOLUTION","volume":"20 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-12-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"126494288","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

{"title":"Best Practices Adopted by Universities in The Development of Mediation in The Czech Republic","authors":"Pavlína Krausová, Hana Láníková","doi":"10.52028/rbadr.v3i5.10","DOIUrl":"https://doi.org/10.52028/rbadr.v3i5.10","url":null,"abstract":"This article provides a comprehensive overview of key practices that may be adopted by the universities in order to advance mediation as a dispute resolution method among young professionals and key stakeholders of dispute resolution. The findings are based on the case study of the Charles University, Faculty of Law, which has been chosen due to its sharp rise in the number and variety of theoretical and practical university offerings related to mediation. It, therefore, represents a sustainable model of a progressive university program. The authors describe and analyse a full range of its university classes, summer schools, workshops, student societies, competitions, and conferences, many of which are self-organized by the students and university alumni themselves. They report how the various mediation activities developed over time, what contributed to their success, or posed a challenge, and offer an insight into the specific curriculums and practical methodologies. While they may be context and location-specific, the authors believe they are transferable and have the potential to serve as valuable inspiration for other developing ADR programs. To put those educational efforts into a broader context, the authors consider the state of the legal development of mediation in the Czech Republic. e Mediation has been introduced into its respective legal system only after the establishment of the democratic government in 1989, due to it being a communist country. Yet it took more than twenty years to adopt a legal framework that would regulate the basic principles of mediation and its exercise. Furthermore, the authors briefly draw attention to some of the challenges mediation is facing in the Czech Republic after the adoption of the Mediation Act in 2012. They consider in more detail how the specific obstacles may be mitigated by the proactive approach of the universities, especially law faculties, which have a direct relationship with the future driving forces of dispute resolution, such as future legislators, judges, and other professionals. The authors express a notion that the university activities are likely to have a positive impact on the (herein referred to as “ADR”) culture in the Czech Republic, especially in the following years, which is supported by the latest programs developed by government institutions and private parties which are emerging continuously, some of which have direct or indirect relationships, and contact with the university environment. Finally, they provide concrete recommendations as a list of best practices, which were gathered from the analysis of the case study of Charles University.","PeriodicalId":101933,"journal":{"name":"REVISTA BRASILEIRA DE ALTERNATIVE DISPUTE RESOLUTION","volume":"114 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-06-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"127949359","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The practice of the main foreign arbitral institutions shows that for more than 50 years they have gradually assumed this responsibility, although they still give different levels of transparency to the procedural acts of public-private arbitration. This is because the jurisdictional nature of the arbitration reveals that transparency can only be provided by those to whom impartiality and – ideally – also institutionality is granted, similarly to the transparency of judicial acts, as determined by the Constitution. Consequently, it is up to Brazilian arbitral institutions, as their foreign counterparts already do, to provide transparency of public-private arbitration. In ad hoc arbitration, the arbitral tribunal should carry out such obligation, as it is the only other impartial actor in arbitration.","PeriodicalId":101933,"journal":{"name":"REVISTA BRASILEIRA DE ALTERNATIVE DISPUTE RESOLUTION","volume":"29 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-06-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"125487889","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The focus will be to highlight the differences between the two types of experts. For the purposes of this paper, we will draw a spectrum with two extreme examples of expert witnesses. On one extreme of the spectrum, there is the expert who makes a living out of expert work and thus is seen to be closer to the client. On the other extreme of the spectrum, there is the expert who is providing an opinion on something that is his or her life’s work, this expert might never have given an expert report before. Both ends of the spectrum are heavily criticized.
