Since then, bioethics has been predominantly used as a new process to express moral rules and repress social evolutions in extremely sensitive fields in society such as assisted procreation techniques and new family planning, sexual abuse of children and sexual liberation, palliative care, euthanasia and quality of life and death.Using examples at the extremities of life (in vitro fertilisation and euthanasia) it will be demonstrated that no single approach to bioethics exists which is often confused with the concept of morals or laws. Genetic engineering has, however, presented a unique challenge to the traditional requirements and scope of patentability in Europe and America. The USA has been responsive to the genetic engineering of animals when interpreting its law, due to the revolutionary Chackrabarty decision in 1980 which opened the way to the patenting of life forms. European law, guided by the European Patent Convention, has been less able to adapt quickly to the concept of animal patents. It was the historical Harvard Mouse that caught the world's attention, and since then animal patenting has been the focus of heated legal and social debate in Europe and America. This has prompted debate about the ethical justification of presymptomatic testing of adults. The presymptomatic testing of children is an ethical issue that is even more complex. However, those providing genetic counselling on such topics must consider not only the wishes of the parents but also the rights of the child. This paper reports on a qualitative study of thirty families attending an out-patient Regional Genetics Clinic, and discusses the problems that the genetic counsellor faces in negotiating the everyday exigencies of such work. In particular, we focus on the question of how guidelines, or protocols might help counsellors deal with these routine, practical, dilemmas. Sutton","doi":"10.1179/HRGE.1.1.276042718403JH80","DOIUrl":"https://doi.org/10.1179/HRGE.1.1.276042718403JH80","url":null,"abstract":"With the possibility of gene therapy on the horizon in the case of illnesses such as cystic fibrosis, it is probable that some parents, who in the past would have chosen prenatal diagnosis with a view to selective abortion (Royal College of Physicians 1989), in the future will chose neonatal or prenatal diagnosis with a view to gene treatment, should their child be affected by a treatable genetic illness. This is welcome news not only for those who view abortion as an act of homicide, but also for many prospective parents of a different outlook. The possibility of treatment would spare many women (who might otherwise have contemplated the possibility of abortion) the agonising choice between going through the ordeal of having an abortion and loosing a child or giving birth to a child facing a life, the length and quality of which would to be affected by illness and suffering.
