The trial court found the inmate was dangerous to himself and others but refused to transfer him in view of an agreement between the DHS and the Department of Corrections which provided for the inprison treatment of inmates under certain circumstances. The Superior Court affirmed the lower court's decision, amending it only to allow periodic review pursuant to statute. The inmate was not entitled to the full range of rights available to persons involuntarily committed because any long term treatment program would be inconsistent with his death row status.","PeriodicalId":80589,"journal":{"name":"Atlantic reporter","volume":"558 1","pages":"1357-63"},"PeriodicalIF":0.0,"publicationDate":"1989-01-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"69170592","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Her husband applied to the New Jersey Superior Court, Chancery Division, Ocean County, to be apponted her special medical guardian with express permission to remove the respirator. The court granted the request, pending appellate review.
