{"title":"Unamendability and the Genetic Code of the Constitution","authors":"Yaniv Roznai","doi":"10.2139/SSRN.2569279","DOIUrl":"https://doi.org/10.2139/SSRN.2569279","url":null,"abstract":"An increasing number of constitutions contain “unamendable provisions” in order, inter alia, to protect essential characteristics of the constitutional order or principles perceived as being at risk of repeal via the democratic process. The paper examines unamendable provisions. In order to do so, it studies the text of unamendable provisions which were and are stipulated in 735 former and current written national constitutions. It reviews the origins, structure and content of unamendable provisions, seeking any content-based or material links among them. It also analyzes the characteristics of unamendable provisions and identifies various features of unamendability such as preservation, transformation, aspiration, conflict-management and bricolage. Unamendable provisions fulfill certain functions and reflect the important symbolic value of certain constitutional principles or institutions. {"title":"Solidarity between States in the Global Legal Space","authors":"L. There is no conclusive answer to this question, because solidarity can often wear more coats and operate both as a value and as a principle. To address these issues, this paper will first provide some historical and theoretical remarks on the idea of solidarity and its multiple meanings. Thereafter, it will focus on the solidarity both as a value, in its constitutional dimension, and as a principle, in its administrative dimension. It will then examine the ambiguous relationship between solidarity and sovereignty. One of the limits to this process of nationalization is the power, conferred solely upon the European Court of Justice (ECJ), to ensure, through the preliminary ruling procedure, the uniform interpretation of European law. In order to preserve this function of the ECJ, the Rheinmuhlen case law established that the capacity of lower courts to ask preliminary questions cannot be curtailed by a rule of national law whereby a lower court is bound to the rulings of a higher court. In the recent Elchinov case, Advocate General Villalon questioned the necessity to maintain this case law. Does the French Government possess the strongest possible armour in order to assure its domination over the legislative procedure and does it use it in an abusive manner? A comparative study of the different steps of elaboration of the law in German, British, French and Italian parliamentary regimes informs us that the theory on the abnormality of the French rationalised parliamentarism must be reversed. All of these Governments possess equivalent procedural means in order for them to have their bills adopted. The accumulation of the majority rule and the implementation of rationalised parliamentarism should not be analysed, as such, as a singularity in the way of exercise of governmental power. {"title":"Administrative Law in Europe: A Historical and Comparative Perspective","authors":"G. D. Cananea","doi":"10.2139/SSRN.2327934","DOIUrl":"https://doi.org/10.2139/SSRN.2327934","url":null,"abstract":"There is currently a growing interest in the question whether a convergence between the administrative laws of European countries is coming into being and, if so, whether this is desirable or otherwise, as well as whether and the extent to which this depends on broader process of European integration and globalization. This article addresses the question of the limited use of comparative analysis with regard to administrative law, by arguing that it depended on cultural prejudices, the underlying idea being that, unlike private law, administrative law was but a product of each State and its national culture. The article challenges this received idea, by pointing out the importance of transplants and cross-fertilization. It argues, secondly, that administrative law must be considered in a dynamic perspective, and thus focuses on some dynamics of change: the growing importance of public authorities within and outside the Nation-States; the emergence of a common core of general principles of law; the procedural principles that have emerged in national administrative law systems; and finally, the gradual erosion of the areas of immunity. The article expresses, however, a sceptical note with regard to any vision of administrative law that emphasizes progress, arguing that some techniques of administration often regarded as innovative are not at all new. It observes, moreover, that administrative law is still characterized by a fundamental ambivalence between different ideals and forces.
