It examines a number of aspects of Waqf in Afghanistan, such as its historical development of Waqf, the existence of Waqf laws in the country, its evolution throughout time, common difficulties of Waqf, a lack of awareness among the general public even on institutional level, and the required and necessity of updating Waqf customs in the nation. Amidst Afghanistan's ongoing problems with extreme poverty and high jobless rates brought on by years of hostilities and civil war. We believe that there is a chance to revive the Waqf tradition and modify it for use in modern settings. Afghanistan might learn from other prosperous Muslim countries by using Waqf as a tool for economic growth and creating a structure and plan that support charitable endeavors and self-sufficient Waqf-based institutions in the nation. Waqf is well-positioned to assist governmental initiatives in meeting community needs and achieving development goals within Waqf institutions in Afghanistan by fostering social welfare and promotes growth and development of the economy. The main objective of this research is to undertake an overall relevance of the historical Waqf in the Islamic Economic system. It will elaborate on Waqf juristically, classically and modernly. The study explored various aspects such as Waqf's meaning, different definitions by several religious schools of thought, historical origins, and legitimacy of the Waqf based on Quranic Verses and Hadith of the Prophet (PBUH). Throughout Islamic civilization, Waqf played a vital role in Muslim society, given that the needs of the Muslim Ummah were complex and growing. The objective of Waqf is to promote social welfare and to contribute to economic development. {"title":"ECONOMIC POTENTIAL OF WAQF FOR SOCIAL WELFARE: PATTERNS AND CONTRASTS IN MENAP AND COUNTRIES IN SUB-SAHARAN AFRICA","authors":"","doi":"10.46281/ijswr.v4i1.2079","DOIUrl":"https://doi.org/10.46281/ijswr.v4i1.2079","url":null,"abstract":"The Waqf has become a matter of increasing priority for Islamic scholars and policymakers, given its potential as a mechanism for the socioeconomic advancement of Muslim communities worldwide. This systematic literature review investigated the critical economic and social dimensions of the Waqf in the Middle East, North Africa, and Pakistan (MENAP) region and predominantly Muslim nations of sub-Saharan Africa. Through a rigorous examination of academic databases, 61 relevant primary sources published since 2014 were analyzed using thematic analysis techniques to uncover patterns and contrasts in managing and utilizing the Waqf across countries. The findings reveal significant diversity in Waqf economic strategies implemented, with greater uptake of Cash Waqf and Waqf-based microfinance in MENAP countries compared to sub-Saharan Africa, where adoption is limited. Approaches also diverge regarding the investment of Waqf assets in financial products, with higher prevalence in the Gulf countries than elsewhere. In the social dimension, Waqf has funded traditional educational institutions in MENAP, but the innovation support is largely untapped. Health care and affordable housing are recurring areas of Waqf's contribution, but the impact is uneven: countries like Kuwait and Qatar show more advanced development than Yemen. Women's economic empowerment through the Waqf is more pronounced in the Gulf region than in countries like Nigeria. The institution of Waqf has been an effective way of reducing and eradicating poverty among Muslim communities. Yobe state government established the zakat and waqf management department under the Ministry of religious affairs (MORA) following the declaration of the Shariah system in the state on the 23rd of October 2002 to manage all activities related to zakat and Waqf. The aims and objectives of the institution are to promote the social welfare of the communities and to promote the socio-economic status of Muslims. Yobe state government engaged in establishing one of the most notable waqf investments in the state to promote charitable activities and encourage the Muslim community to continue investing in institutional waqf. However, despite establishing the institution, very few institutionalized waqf practices could be traced in the state. Thus, this research aims to examine the problems affecting the institution of waqf in Yobe State and recommends solutions to address the identified problems. The purpose of this case is to describe a recent Sukuk issued by Pakistan Mortgage Refinance Company (PMRC), a Mortgage Liquidity facility that issued Musharka Sukuk based on Shirkat-ul Aqd, aimed at developing housing finance market in Pakistan. Given the acute shortage of houses and reluctance amongst banks to grant consumers housing loans for a longer-term duration, this facility will enable affordable house financing through a Shariah-compliant mode, while offering a new avenue of investment for capital market participants. This paper describes the key features of the Sukuk, outlines its Shariah structure, and elaborates upon the mechanism of the transaction. A graphical illustration of the Sukuk structure is made to facilitate the reader’s understanding of each step of the transaction. The PKR 3.1billion PMRC Sukuk with the fixed-rate offering of 8.25% for 3 years is expected to be a landmark for the development of the housing sector of the country. This poses serious threat to the level of competition with conventional ones unless they are technically efficient. Unfortunately, available evidences have shown that Islamic banks in Africa are technically inefficient, though no consensus have been reached on the source(s) of such inefficiency. Therefore this study investigated the technical efficiency of Islamic banks in Africa with particular emphasis pure technical and scale efficiencies. Convenient sampling technique was used to select a sample of 36 Islamic banks for eight (8) years from 2012 to 2019. Data were collected for input and output variables from annual reports of the banks. Data Envelopment Analysis (DEA) was used to analyse the data by estimating the efficiency scores for the banks. The efficiency scores of 0.764 (ar<1), 0.850 (ar<1) and 0.896 (ar<1) for OTE, PTE and SE respectively indicate that on average, the selected banks were technically inefficient. The study concluded that Islamic banks in Africa were technically inefficient due mainly to pure technical inefficiencies such as poor managerial performance. This is one of the Islamic institutions that have existed since the time of the Prophet (PBUH). The Sri Lankan management operations of Waqf were exercised institutionally as early as 1956. Due to the improper management of waqf assets, society has faced several problems such as poverty, unemployment, recession in education. Therefore, this study aims to identify the legal and practical challenges faced by Waqf institutions in terms of proper implementation of the Muslim Mosques and Charitable Act- 1956 (Wakfs Act of Sri Lanka). The method of the qualitative study was used. The findings demonstrate that there is no authority to the waqf Tribunal to amend a verdict, the Waqf Tribunal depends on the District Courts in implementing the judgments and there are deficiencies in the selection of trustees or mutawallis. This study concludes with the argument that the institutional process of the Sri Lankan Waqf act has legal and practical shortcomings. Descriptive and analytical method was used, and a questionnaire consisting of (36) paragraphs covering all the study variables was designed and distributed to the study community consisting of 4 Islamic banks working in Palestine. The study concluded with a set of results, the most important of which is the fear of issuing Islamic sukuk by Islamic banks due to the lack of sufficient technical capacity and experience to work in this financial industry, in addition to the weak cultural awareness among the Palestinian public of what sukuk are, their types, nature and importance, in addition to the lack of economic clarity and lack of appropriateness of environmental conditions surrounding the Palestinian national economy, which generates concerns about these sukuk, and the absence of an appropriate legislative and legal environment for issuing these sukuk constitutes an impediment to those banks for issuing them.
