My claim is not that harmful activities of currently existing corporations warrants their losing corporate status according to the harm principle. The claim, rather, is that taken strictly, the harm principle and the legal possibility of incorporation are mutually exclusive. This view may be surprising—and I do not at all mean to attribute it to Mill—but if I am right, it should be obvious. It should also encourage us to think more about the nature of the markets within which business occurs. In the first section, I layout the view that follows from accepting the harm principle. In the second section, I explain the basic nature of legal incorporation. In the third section, I lay out the brief, but I think decisive, argument that the endorsement of the harm principle (as understood in the first section) is necessarily opposed to legal incorporation. I consider objections in the final section.","PeriodicalId":167105,"journal":{"name":"Toleration and the Challenges to Liberalism","volume":"23 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2020-10-19","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"123682744","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Toleration is among the most pivotal and the most contested liberal values and virtues. Debates about the conceptual scope, justification, and political role of toleration are closely aligned with historical and contemporary philosophical controversies on the foundations of liberalism. The essays in this volume focus on the specific connection between toleration and liberalism. The essays in Part I reconstruct some of the major historical controversies surrounding toleration and liberalism. Part II centers on general conceptual and justificatory questions concerning toleration as a central category for the definition of liberal political theory. Part III is devoted to the theoretical analysis of applied issues and cases of conflicts of toleration in liberal states and societies. Toleration and the Challenges to Liberalism will be of interest to researchers and advanced students in social and political philosophy, ethics, and political theory.","PeriodicalId":167105,"journal":{"name":"Toleration and the Challenges to Liberalism","volume":"37 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2020-10-19","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"115126957","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
