摘要

本文分析了我国现行颜色商标注册的立法和实践。对颜色作为商标的保护范围进行了研究。确定了一个细分市场的制造商广泛使用颜色名称的潜在问题。为了防止商标所有人之间的纠纷，实现商标所有人利益的平衡，笔者提出了完善颜色商标注册程序的建议。
