Gestational surrogacy is legal in India. One of the few nations where commercial surrogacy is still legal in India. However, there is no legal prohibition against commercial surrogacy in India. This suggests that although commercial surrogacy is not illegal in India, neither is there specific legislation regulating it. Even while women have benefited from increased access to educational and employment opportunities as a result of globalisation, the gap between the gender has only widened on a global and local scale.
