SERVIÇOS ECOSSISTÊMICOS HÍDRICOS NA ÓTICA DO CAPITAL NATURAL E SUA LEGITIMIDADE LEGAL

In the last several decades, the socioeconomic evolution and the process of the exploitation of natural resources have grown exponentially in the world, requiring various public and private sectors to act regarding prevention and control to reduce environmental degradation. The purpose of this article is to discuss the importance of the economic evaluation mechanism integrated with the legal system as a way to promote economic development linked to a system of management and governance without legal instability and leveraging new investments. Given this dynamic effect of the legal-economic context, a new perspective of interpretation and application of laws and regulations in the environmental area is instituted, primarily to measure the economic impact of the natural capital of water when the laws require it. Hence the need arises for an ongoing global debate to understand this dynamic involving the degree of importance of natural water resources in the temporal and spatial sphere, as the limitation of the good is perceived in the face of the difficulty of promoting its substitutability.
