Prise en charge d’une suspicion de maltraitance infantile : le cadre médico-judiciaire
Child abuse is a major public health and justice issue in France. This article explains the practices involved in the medico-judicial process, from reporting to judicial investigation. The main difficulties encountered by healthcare practitioners faced with a situation likely to give rise to a report are discussed. For example, medical confidentiality, often perceived as an obstacle, does not prevent a report from being made in cases of suspected abuse, in accordance with the provisions of article 226-14 of the French Penal Code. The placement of a child remains an exceptional measure, decided to guarantee the child's safety, while preserving family ties if possible. The hearing of the child victim follows strict protocols to ensure that the child's voice is heard without influencing him or her, while minimizing the trauma. Finally, forensic and psychological expertise plays a crucial role in assessing the extent of physical injury and psychological impact. Professional coordination and training are essential to optimize the management of these complex situations.
