This research aims to thoroughly examine this issue. The research method used in this study is normative juridical, utilizing secondary data. The research results indicate that dual certificate cases in Indonesia constitute wrongful acts committed by government bodies or officials (Onrechtmatige Overheidsdaad). As such, these cases cannot be adjudicated in the general courts. Therefore, if such cases have already been filed in the general courts, they must be transferred to the Administrative Court by the provisions of the legal regulations. 摘要
印度尼西亚的双重证书发放问题是一个尚未解决的典型问题,其中一个问题是,此类案件的解决是属于行政法院(Pengadilan Tata Usaha Negara)的管辖范围,还是属于普通法院的管辖范围。本研究旨在深入探讨这一问题。本研究采用的研究方法是规范法学,利用的是二手数据。研究结果表明,印尼的双重证书案件构成政府机构或官员(Onrechtmatige Overheidsdaad)的不法行为。因此,这些案件不能由普通法院判决。因此,如果此类案件已在普通法院立案,则必须根据法律规定移交行政法院。因此,双重证书案件属于行政法院的绝对管辖范围。
