This study uses a qualitative descriptive analysis method with a historical juridical approach. The data collection technique in this research is based on a case study in the form of a sharia system mortgage which refers to classical jurisprudence books in Cipanas sub-district, Lebak Banten Regency. Next, analyze the texts that are references for the local community in sharia pawning.
