The research used a normative juridical method. The results showed that; 1) legal protection against the circulation of counterfeit goods can be carried out based on criminal, civil and administrative law. Trademark infringement in the form of brand counterfeiting is further regulated in Law Number 20 of 2016 concerning Trademarks and Geographical Indications. In more detail, the act violates the Criminal Provisions of Article 100, Article 101 and Article 102. While the use of a trademark is without rights, it can be sued based on an act of violating the law in accordance with Article 1365 of the Civil Code. 摘要

本研究的目的是分析社会对假冒商品流通的法律保护。该研究采用了规范的法律方法。结果表明:;1)针对假冒商品流通的法律保护可以从刑法、民法和行政法三个方面进行。2016年关于商标和地理标志的第20号法律进一步规范了假冒品牌的商标侵权行为。具体来说,违反了刑法第一百条、第一百零一条、第一百零二条的规定。虽然商标的使用没有权利,但可以根据《民法典》第1365条的规定以违反法律的行为提起诉讼。行政上,可以根据相关法律进行审查,例如在网上交易中参考2008年第11号关于电子信息和交易的法律。2)法律保护假冒商品经销商的障碍是a)违反假冒商品构成投诉罪,因此需要品牌所有者发挥积极作用,b)公众(消费者)对商标注册申请存在的信息有限。c)商标权利人难以找到商标侵权行为人。d)品牌权所有人的诉讼的存在会使产品的美誉度恶化,e)社会的法律意识和法律文化。
