French Abstract: Abstrait français: Dans le milieu communautaire, on utilise sans distinction les termes « organisme à but non lucratif » (OBNL) et « organisme sans but lucratif » (OSBL). Est-ce vrai que les deux veulent dire la même chose? Un torchon est-il une serviette? La question se pose dans un contexte de transition et de transformation où le pouvoir public cherche à refiler ses responsabilités, notamment dans le domaine du social, vers de nouveaux partenaires privés et philanthropiques. Ce contexte a donné naissance à de nouvelles formes d’organismes privés, dont les entreprises d’économie sociale. Le contexte change. La loi ne suit pas les changements qui la dépassent. Un flou s’installe. De nouvelles questions se posent… English Abstract: Within Québec's community movement, we tend to use without distinction the terms "not for profit" and "non-profit" organisations. Do both terms mean the same thing? Is a towel, a rag? The question is raised in a context of transition and transformation as governments seek to transfer responsibilities, particularly in the social field, towards private and philanthropic organisations. The context has given rise to new forms of private organisations, including those in the so-called field of "social economy". In this context of change, the law has fallen behind.
