The administrative preclusion, which corresponds to the “res judicata” of the judicial process, render the administrated person safe and sound from new investigations in relation to the same fact, but not in relation to new facts, posterior to the preclusion. The Administration has to follow the principles of impartiality and impersonality, as well as the principle of the legitimate confidence, in which the principles of juridical security and of good faith are anchored.
