The article examines the main conditions and limitations for the establishment of the right of superficies, providing an evaluation about certain problematic aspects thereof from the perspective of comparative law, as well as exploring the right of superficies institute regarding the possibility to attribute such right to a building that has already been constructed, thereby ensuring such building’s further usage and at the same time recognizing that such building is to be deemed as an essential part of the respective right to superficies that has been granted.
