EU Bestuurlijke Regelgeving in De Praktijk: Het IORP II Richtlijn-Voorstel Als Voorbeeld (EU Administrative Rules in Practice: The Example of the Proposed IORP II Directive)

Dutch Abstract: Het onderscheid tussen wetgeving en bestuurlijke regelgeving en tussen delegatie en uitvoering uit het EU-Verdrag bepaalt het wetgevingssysteem van de Europese Unie. Aan de hand van de herziening van de IORP-richtlijn wordt de uitwerking van dit systeem in de praktijk geanalyseerd. Niet alleen geven beide onderscheiden aanleiding tot conflicten tussen vooral nationale en EU-wetgevers, maar ook worden geschillen over de inhoud van EU-regelgeving uitgevochten. Ook biedt het artikel nader inzicht in de rol van EIOPA, het EU agentschap op het terrein van pensioenen.English Abstract: The legislative system of the European Union is determined by the distinction made between legislation and administrative rules and between delegation and implementation pursuant to the EU Treaty. This article analyses the implementation of this system in practice, on the basis of the revision of the IORP Directive. Not only do both distinctions give rise to conflicts between mostly national and EU legislatures but they also lead to disputes regarding the substance of the EU rules. This article also provides more detailed insight into the role of the European Insurance and Occupational Pensions Authority (EIOPA).
