ÉTICA E DISCURSO JURÍDICO: A ÉTICA DO ORADOR COMO CONDIÇÃO ESSENCIAL DA RETÓRICA

O presente trabalho demonstra que a ética do orador representa uma das condições essenciais, e a mais importante, para o êxito de um processo argumentativo, inclusive, da argumentação jurídica. É o orador que determina a qualidade e a finalidade da argumentação: se voltada para o bem comum, ou se realizada para atender aos interesses de particulares. A ética do orador será analisada sob a perspectiva da retórica clássica, demonstrando-se que a argumentação virtuosa é aquela praticada por um orador que conduz o discurso pautado em atitudes éticas, cujas ações refletem a prudência, a virtude e a benevolência.

ETHICS AND LEGAL DISCOURSE: THE ETHICS OF THE ORATOR AS THE ESSENTIAL CONDITION OF RHETORIC

Abstract: The present work shows that the ethics of the orator represents one of the essential conditions, and most importantly, for the success of an argumentative process, including legal argumentation. It is the orator who determines the quality and purpose of the argumentation: whether it is aimed at the common good or whether it is performed to serve the interests of individuals. The ethics of the orator will be analyzed from the perspective of classical rhetoric, demonstrating that the virtuous argumentation is that practiced by a orator who conducts the speech based on ethical attitudes, whose actions reflect prudence, virtue and benevolence.
