Submission of evidence at the appeal instance is permitted only in exceptional cases, and under the condition that its non-submission at the first instance did not depend on the will of the parties to the case. Studying court practice shows that it is currently not possible to change the existing regulation of the law and refuse to present new evidence at the appeal instance.
