O DIREITO AO ESQUECIMENTO: A EXCLUSÃO DE NOTÍCIAS QUE FEREM A INTEGRIDADE E INTIMIDADE DA PESSOA E A ATUAL DISCUSSÃO DO SUPREMO TRIBUNAL FEDERAL

O direito ao esquecimento surge através de um longo processo histórico, tomando espaço nas jurisprudências e normatizações. Entretanto, no Brasil, o direito ao esquecimento vem sendo questionado, voltando a ser alvo de discussões dentro dos Tribunais, que acreditam na sobressalência da liberdade de expressão, mesmo que interfira gravemente na vida dos envolvidos do processo. Com a necessidade de demonstrar a importância da intimidade da pessoa humana, buscar-se-á explicar a gravidade da exposição midiática e a perda do direito ao esquecimento, direito este de suma importância para integridade do ser humano. Dessa maneira, o assunto tem grande relevância nesta temática pouco discutida, e que merece enfoque na atualidade. A metodologia utilizada é bibliográfica documental através do método indutivo com estudo de caso. PALAVRAS CHAVE: Direito; esquecimento; integridade. ABSTRACTThe right to be forgotten arises through a long historical process, taking space injurisprudence and regulations. However, in Brazil, the right to be forgotten has beenquestioned, returning to the subject of discussions within the Courts, which believe in thesupremacy of freedom of expression, even if it seriously interferes in the lives of thoseinvolved in the process. With the need to demonstrate the importance of human intimacy,it will seek to explain the seriousness of media exposure and the loss of the right to beforgotten, a right that is of paramount importance for the integrity of the human being. Inthis way, the subject has great relevance in this little-discussed theme, and which deservesfocus today.
