Some Issues of Legal Protection of Color Trademarks

Abstract

The article analyzes the current legislation and practice of registration of colour trademarks. The limits of protection a colour as a trademark are researched. Potential problems of the widespread use of colour designations by manufacturerы of one market segment are identified. Author makes some proposals to improve the procedure for registering a colour trademark in order to prevent disputes between trademark owners and to achieve a balance of their interests.
