{"title":"Special rules regarding the perpetrator’s collaboration with the criminal prosecution authority in the investigation of organized crime offenses","authors":"Maxim Gropa","doi":"10.52673/18570461.23.1-68.09","DOIUrl":null,"url":null,"abstract":"Resulting from the provisions of art. 1 of the Code of Criminal Procedure establishes that the criminal process aims to protect the person, society and the state from crimes, as well as to protect the person and the society from the illegal acts of persons in positions of responsibility in their activity related to the investigation of alleged or committed crimes, so that any person who has committed a crime shall be punished according to his guilt, and no innocent person to be held criminally liable and convicted. At the same time, the criminal procedural legislation, in the case of the perpetrator’s collaboration with the criminal investigation body, provides for the mechanism of releasing them from criminal liability, thus manifesting its policy in order to encourage guilty persons prone to follow the path of correction, by showing their attitude towards the crime committed and the prevention of harmful consequences intended to affect the legal order.
