ANÁLISE DA AUTONOMIA DA AGÊNCIA ESTADUAL DE REGULAÇÃO DE SERVIÇOS PÚBLICOS DE ENERGIA, TRANSPORTES E COMUNICAÇÕES DA BAHIA – AGERBA E AGÊNCIA REGULADORA DE SANEAMENTO BÁSICO DO ESTADO DA BAHIA – AGERSA

Abstract

This article talk about the State Regulatory Agency for Public Energy, Transport and Communications Services of Bahia (AGERBA) and the Basic Sanitation Regulatory Agency of the State of Bahia (AGERSA), the only regulatory agencies in the State of Bahia. The proposed objective was to analyze the autonomy of these agencies before the Executive Branch of the State of Bahia, verifying if the directors have functional, administrative and financial independence, being able to exercise their regulatory role. The research was reasoned under the legal-dogmatic methodological aspect, analyzing the current legislation, as well as the legal concepts related to the theme. It concluded that the regulatory agencies have only formal autonomy, without the one that would characterize them as special autarchies, thus preventing the full exercise of the regulatory function.
