Asal Usul Kebijakan Pencadangan Hutan Adat di Indonesia

Abstract

Abstract: In Indonesia, recently a movement to recognize customary forests (hutan adat) and the rights of indigenous peoples over forested areas has culminated. This momentum marked Indonesia's first recognition the traditional rights of indigenous peoples over their forests. This paper explains how the proposed to reserve the customary forest policy has been made and describe the journey as well of the implemention that policy. This scheme can help the struggle of indigenous peoples to show that the government can engage with social transformation from the bottom up. This study took the action research method from my experience working as a researcher to produce the target of agrarian reform and social forestry in Indonesia. This study takes the concept of a social construction framework to look the narrative ideas about reserving the customary forest in Indonesia. The results concluded with the problematic tabulation of data that can be formulated by conducting the reserve of the customary forest to implement the agenda of agrarian reform and social forestry in Indonesia.Keywords: Adat communities, Adat law, Customary Forest.Intisari: Di Indonesia, belakangan ini sebuah gerakan pengakuan hutan adat dan hak masyarakat hukum adat atas wilayah hutan memuncak. Momentum ini menandai pengakuan pertama kalinya Indonesia atas pengelolaan tradisional masyarakat hukum adat atas hutannya. Makalah ini ingin menjelaskan mengenai bagaimana usulan kebijakan pencadangan hutan adat dibuat serta perjalanan dalam mengimplementasikannya. Skema ini dapat membantu perjuangan masyarakat adat untuk menunjukkan bahwa pemerintah dapat terlibat dengan transformasi sosial dari bawah ke atas. Studi ini mengambil metode penelitian riset aksi dari pengalaman saya bekerja sebagai peneliti untuk menghasilkan sebuah target reforma agraria dan Perhutanan Sosial di Indonesia. Studi ini mengambil konsep kerangka konstruksi sosial untuk mencari ide naratif tentang pencadangan hutan adat di Indonesia. Hasil penelitian ini menjelaskan adanya tabulasi data dengan problematikanya yang dapat diformulasi dengan melakukan usulan pencadangan hutan adat dalam mewujudkan agenda reforma agraria dan perhutanan sosial di Indonesia.Kata kunci: Masyarakat adat, hukum adat, hutan adat.
