Abstract
Canada's Medical Assistance in Dying (MAID) legislation has raised significant bioethical debates over medically assisted death. These debates specifically relate to concerns over whether MAID legislates the belief the people with disabilities' lives are inherently negative. This paper examines MAID and these debates through Marth Nussbaum's capabilities approach and Eva Feder Kittay's care centric conception of disability. It questions to what degree MAID legislates the belief that disability is an inherently negative condition of life and how to best address socio-political factors that contribute to a negative condition of life.
