Abstract

There is a set of important principles and foundations, which must be available for any fair judicial system. This is because these principles and foundations are a fence that protects justice and important guarantees of the proper functioning of the judiciary. These principles include universal assets and the holistic rules governing the judicial system. and, in essence, these principles should serve as a beacon for the judge in his judgement, and as an essential reference for the achievement of justice and, because of the importance of these principles, many States have enshrined them in their constitutions in old and modern times, as contained in the laws on the judiciary, The problem of looking at the question is what are the most important principles, what are their guarantees and what is their impact on the judge to achieve a fair trial and what were those principles in urban history in addition to the most important qualities to be found in the judge in order to achieve this. Through this research, we will try to highlight the most important principles of modern times compared to urban history and demonstrate their impact on the achievement of a fair trial. In addition to analysing the role of the judge in their application, we will undertake a number of research curricula, the most important of which will be descriptive when describing and describing certain specific concepts. and the inductive approach when tracking the parcels of principles and related to them, Analytical when limiting and arranging results, and introspective to reach the connected results to solve the research problem and through this we have reached a number of conclusions and recommendations that reflect the positive impact of today's judicial and al-Hadrami judicial systems.
