Abstract

Étant confronté à un médecin conseiller technique d’une partie qui refuse de lui transmettre les pièces demandées au motif qu’il n’est pas médecin, un kinésithérapeute expert judiciaire informe le tribunal judiciaire. Celui-ci organise alors une audience et le jugement constitue une véritable avancée dans la reconnaissance de la légitimité et de la compétence des kinésithérapeutes à réaliser des expertises médicales. Dans le jugement, le tribunal s’appuie sur la formation de l’expert judiciaire et sur la non-exclusivité des expertises médicales aux médecins. Ce jugement est capital pour les kinésithérapeutes formés à l’expertise judiciaire.

Being confronted with a medical technical advisor to a party who refuses to forward the requested documents on the grounds that he is not a doctor, a judicial expert physiotherapist informs the judicial court. The latter then organizes an audience and the judgment constitutes a real step forward in the recognition of the legitimacy and competence of physiotherapists to carry out medical expertise. In the judgment, the court draws on the judicial expert's university education and on the non-exclusivity of medical expertise to doctors. This judgment is of vital importance for physiotherapists trained in judicial expertise.
