Abstract

研究目的：a) 了解并分析银行移动银行服务中客户个人数据保护的法律安排是否仍然存在损害客户利益的情况。b) 根据 2022 年第 27 号法律，了解并分析银行对客户个人数据保密的责任。本法律研究采用的方法是规范性法学研究方法，即从法律法规、书籍、期刊和论文以及其他判例中进行实质性研究。不过，本研究也以实证研究为基础，从实地研究中获取数据。因此，法律保护和法律确定性理论在法律监管中与移动银行服务中的客户个人数据保护有着密切的关系。法律保护理论强调保护人权，包括个人数据保护权的重要性。个人数据保护权是《1945 年印度尼西亚共和国宪法》（UUD 1945）第 28G 条第（1）款所保障的一项人权。
