PENGGADAIAN SAWAH DAN LADANG DI KECAMATAN CIPANAS KABUPATEN LEBAK DALAM PERSPEKTIF SYARIAH

Abstract

This research aims to reveal analytically the sharia mortgage system in Cipanas District, Lebak Banten Regency. This study uses a qualitative descriptive analysis method with a historical juridical approach. The data collection technique in this research is based on a case study in the form of a sharia system mortgage which refers to classical jurisprudence books in Cipanas sub-district, Lebak Banten Regency. Next, analyze the texts that are references for the local community in sharia pawning. From this research it was found that the sharia mortgage system in Cipanas sub-district, Lebak Regency does not fully follow the sharia system contained in the classical fiqh book which they consider as a reference.
