حروب المصالح من منظور السیاسة الشرعیة الأَسْر والأَسْرى نموذجا

Abstract

محتوى هذا البحث هو إضفاء مادة علمیة من أحکام السیاسة الشرعیة علی حروب المصالح التی تقوم بین الجماعات المتصارعة فی داخل الأمة، خاصة فیما یتعلق بالأسر والأسرى بین الدولة وطوائفها کداعش فی العراق، وسوریا وغیرهما. ولقد تضمن ذلک التعریف بالأسر ولأسرى، وحکم أسیر الحرب من المرتدین، والبغاة، والخارجین على القانون، وحقوق هؤلاء الأسرى فی الغنیمة، والإرث، والحریة، ومعاملتهم کالإکراه على العمل، وحبسهم، أو قتلهم، أو إجبارهم على کشف الأسرار العسکریة، مقارنة بمعاهدة جنیف الموقعة بین الدول سنة 1929م. الکلمات المفتاحیة: حروب المصالح – السیاسة الشرعیة – الأسر – الأسیر – الغنائم – داعش Wars of interests from the perspective of legitimate politics Families and prisoners are a model By: Prof Qasim Mohammed Abdul Rahim food International Islamic Science University Sheikh Noah College Judges for Sharia and Law Department of jurisprudence and assets Abstract This research paper addresses the issue of prionors of war who are taken captives during wars among some groups from the ummah who have direct interest in waging wars among themselves. Theses groups include Algaaeda and Daaesish of Iraq and other Arab countries. The paper defined the meaning of War prisoners and war captivity, apostates, and law breaking individuals. Who are called (kharegitesand pugah). in addition to the Islamic ruling on these issues. More over, the paper addresses issueless like inheritance, freedom,and abuse and torture to admit and uncover military secrets as compared to Geneva convention signed 1929.
