المعاهدات فی الإسلام (تطبیق على عهد عمر بن الخطاب رضى الله عنه لأهل إیلیاء (بیت المقدس) دراسة تحلیلیة مقارنة

Abstract

" المعاهدات فی الإسلام  ، تطبیق على عهد عمر بن الخطاب رضى الله عنه  لأهل إیلیاء ، دراسة تحلیلیة مقارنة " د/ فوزی عارف إبراهیم علی أستاذ التاریخ الإسلامی المشارک قسم التاریخ / کلیة العلوم الإنسانیة بأبها جامعة الملک خالد       تهتم هذه الدراسة ببیان غایة الدین الإسلامی وحرصه على التعایش السلمى مع المخالفین فى الشریعة دون النظر إلى شرائعهم ، والتعامل معهم بمعاییر المساواة بینهم ، وإظهار موقف الإسلام فی أنه أباح عقد المعاهدات معهم  ، کما  تتناول الحدیث عن العهد فی القرآن الکریم والسنة النبویة ، وتلقی الضوء على مشروعیة المعاهدات فی الإسلام مع غیر المسلمین ، وشروط ذلک وضوابطه ، والأثار المترتبة علیها ، ثم تهتم بذکر صورا ونماذج من المعاهدات الإسلامیة على عهد النبی- صلى الله علیه وسلم -، کما تهتم بذکر عهد عمر بن الخطاب رضى الله عنه لأهل إیلیاء (بیت المقدس) فی المصادر المختلفة ، وذلک مثل : روایة الیعقوبی ، والطبری ، وابن قیم الجوزیة ، والقلقشندی ، والطبری  ، ثم تهتم بتحلیل نص عهد عمر لأهل إیلیاء " وفق الروایات المختلفة التی وردت فی عدد من المصادر والمراجع ، مع عقد مقارنة بینها ، وبیان الصواب منها ، وغیر الصواب.
