Gender merupakan konsep yang mengacu pada perbedaan peran, fungsi, dan tanggung jawab laki-laki dan perempuan, yang terjadi akibat dari dan dapat berubah oleh keadaan sosial dan budaya masyarakat, implementasi kebijakan pemerintah yang responsif gender, selalu memperhatikan perbedaan kebutuhan, pengalaman serta aspirasi laki-laki dan perempuan, disamping itu juga kesamaan kondisi laki-laki dan perempuan untuk memperoleh kesempatan dan hak-haknya, sebagai manusia agar mampu berperan dan berpartisipasi dalam kegiatan politik, ekonomi, sosial budaya, pertahanan keamanan dan menikmati hasil pembangunan. Salah satu kebijakan yang responsif gender adalah Undang-Undang nomor 13 tahun 2003 tentang ketenagakerjaan yang disingkat UUK 13, dan peraturan pelaksananya, di dalamnya mengatur hak-hak/perlindungan kepada tenaga kerja, didalamnya juga diatur hak-hak dari tenaga kerja perempuan dan diskriminasi terhadap tenaga kerja perempuan . Abstract
