The Content and Essence of Public Property: The Practice of the Constitutional Court of the Russian Federation and the Supreme Court of the Russian Federation

Abstract

The ruling’s of Constitutional Court of the Russian Federation and Supreme Court of the Russian Federation in the matter of realizing rights of public property by public institutions, relationships between public property and common interests of population of a territorial public entity are analyzed in the article. The article is concerned with the reasons of legal position of the courts on recognition of the special legal capacity of public authorities in property relations.
