The expression and utilization of manuscript washing in artificial intelligence products constitutes infringement and does not belong to fair use. Abstract

At present, although artificial intelligence technology is still in the stage of weak artificial intelligence, it depends on the development of digital computing, which breaks the monopoly position of human beings in the field of literary creation, and then the legal subject and behavior of copyright have intelligent tendency, which puts forward new problems in judicial practice. 弱人工智能时代人工智能产品版权的法律分析
目前,人工智能技术虽然还处于弱人工智能阶段,但它依托于数字计算的发展,打破了人类在文学创作领域的垄断地位,进而使著作权的法律主体和行为具有智能化倾向,这在司法实践中提出了新的问题。本文通过分析人工智能生成作品的性质和不同类别的区分,对人工智能生成作品的版权进行具体分析,得出人工智能生成作品的版权属于人的结论。采用“接触+实质相似”的标准,得出基于深度学习的人工智能自主编辑文章不属于侵权的结论。洗稿在人工智能产品中的表达和使用构成侵权,不属于合理使用。思想上利用原始资料洗稿是否构成侵权,需要案例判断。
