Da (Im)Possibilidade da Aplicação do Tema 622 do STF na Adoção

Abstract

Considerando mudanças constantes na organização familiar no que tange as relações familiares, a filiação ganhou nova perspectiva através do princípio da socioafetividade, que trata do reconhecimento jurídico da maternidade ou paternidade com base no afeto, aquele que existe sem que haja vínculo de sangue, a presente pesquisa buscou responder: tendo em vista a tese firmada de n.º 622 do STF, seria possível o reconhecimento concomitante da filiação decorrente do instituto da adoção e da filiação natural? O objetivo foi de analisar o procedimento da adoção e suas implicações em concomitância ao instituto da filiação socioafetiva em nosso ordenamento jurídico brasileiro. A metodologia utilizada foi o método dedutivo e procedimento histórico e técnica de pesquisa bibliográfica e documental. A pesquisa identificou que na hipótese de adoção o tema 622 do STF é aplicável, isso porque não seria impedido que os pais biológicos viessem a se relacionar com o pretenso filho e ter como ele nova posse de estado de filho, independentemente da irrevogabilidade da adoção. The methodology used was the deductive method and historical procedure and technique of bibliographic and documentary research. The research identified that in the case of adoption, the STF theme 622 is applicable, because it would not prevent the biological parents from coming to relate to the alleged child and having a new possession of the child's status as him, regardless of the irrevocability of the adoption.
