Abstract

The purpose of the current article is, by analysing the experience of the state of emergency brought about by the COVID-19 pandemic, to contribute to clarifying the frame of actions and powers of government, determining significant restrictions of fundamental rights (the right of individuals to private life and the right to freely choose an occupation) in emergency situations related to the pandemic. The task of the current paper is, by applying the criteria and methodology for evaluating the permissibility of restrictions of fundamental rights, to assess whether the actions of the government of Latvia, implementing the restrictions of fundamental rights (namely, the requirement for a COVID-19 interoperable certificate in legal relations for all employees in the public sector) were legitimate, necessary and proportionate.
