Abstract
العلاقة بین الأفراد والأسر نظمتا شریعتنا الإسلامیة، ومن ضمن هذه التنظیمات ما یتعلق بعقد الهبة، إلا أنه قد یضطر الواهب إلى الرجوع فی هبته، وهذا حق کفلته له الشریعة الإسلامیة، إلا أنها وضعت موانع لحالات لا یصح فیها رجوع الواهب فی هبته، فکان لا بد من دراسة بعض جوانب الهبة، ومن ذلک تعریف الهبة فی الشرع والقانون، ومشروعیتها، وحکم الرجوع فیها قبل القبض وبعده، والتساؤل بمدى صحة رجوع الواهب فی هبته، وما هی الموانع التی تمنع رجوعه؟
وقد وقعت الدراسة فی ثلاثة مباحث، ومقدمة وخاتمة.

Abstract
The relationship between individuals and families has been organized by our Islamic law, and among these organizations is related to the contract of the gift, but the donor may be forced to return in his gift, a right guaranteed to him by Islamic law, but it has put obstacles in situations where it is not right for the donor to return in his gift, it was necessary to study some aspects of the gift, and from That is the definition of the gift in the Shariah and the law, and its legitimacy, and the ruling on returning it before and after the arrest, and asking the validity of the return of the donor in his gift, and what are the obstacles thataffect his return?
The study was conducted in three chapters , an introduction and a conclusion.
