A hermenêutica jurídica do Art. 1º da Lei Complementar nº 3.843/17 no município de Barra do Garças-MT, à luz da visão holística do meio ambiente e da sociedade de risco

Abstract

The work in vogue aims to denounce legislative deficiency in the environmental field, which leads to the weakening of holistic vision in modern times, as well as evidences the illnesses infiltrated in the State of Environmental Law covered by the Risk Society, causing, in this bias, the legal insecurity. The incidences of the risk society were explained through Beck (1999), Human Rights by Bobbio (2004), the Environmental State and legal hermeneutics from Leite (2012) and the Federal Constitution of 1988. This is a bibliographic research in view of the works. and legislation consulted. The deductive method and qualitative research were used, which involves dynamism between the subjective and objective world. To briefly summarize, the article has resulted in the awareness of the importance of interpreting environmental regulations to effect the submerged Environmental Rule of Law in the risk society.
