Abstract

La cuestión que se plantea consiste en decidir si el trabajador excedente voluntario, cuyo puesto de trabajo continúa vacante, sin que la empresa haya intentado su cobertura con arreglo al convenio y, habiendo realizado contrataciones temporales de puestos del mismo nivel que el demandante, tiene derecho a la reincorporación a la empresa o, por el contrario, no procede dicha reincorporación hasta que no se cumpla el procedimiento de reincorporación de excedentes regulado en el convenio. The issue, which arises in this appeal for the unification of doctrine, consists of deciding whether the voluntary leave worker, whose job is still vacant, without the company having tried to cover it in accordance with the collective agreement and, having hired temporary positions of the same level as the applicant, has the right to reinstatement to the company or, on the contrary, said reinstatement does not proceed until the procedure for reincorporation of workers on voluntary leave regulated in the agreement is fullfilled.
