Concepts, Practices, and Evaluation of Transitional Justice: A Critical Approach

Abstract

This study critically evaluated the generalization efforts of the concept of ‘transitional justice’ and the practices based on them abroad and suggested its implications in the domestic academic world, which transitional justice is arbitrarily applied according to the research topic without consensus on principles and contents even though the importance of transitional justice concept is increasing at the academic level. Since the approach to the definition of transitional justice in Korea has been superficially made from the perspective of legal superiority, there has been a limit to academic and practical expansion. In this regard, this study is expected to provide basic information necessary to establish a theoretical reference framework for transitional justice for Korea's desirable past liquidation and contribute to boosting related discussions.
