: This work, coming from literature, discussed the use of databases in market research in Brazil, considering the rights of personality. We sought to investigate the grievances which are related to the use of computerized data of consumers and their relationship to the revolutionary phenomena occurring in more differentiated areas of life, especially those resulting from new information, problems that are aggravated by the combination of the primacy of economic power with state and legal crisis. Thus, it can be concluded that the potential that technology must be released in an ethical and responsible manner, and not only reprimanded by the establishment of positive legal regulation, being needed a new interpretation of the contract, and to outline what are the most important intersection points between law and economics, in order to observe the impossibility of a purely economic analysis of contract law.
