Notions of the Possible: Smart-Contracts and the Obscene Sign of (Racial) Freedom

ABSTRACT:This paper asks: how does smart-contracting think through the knotted relation between freedom and captivity expressed in contract? Contrary to the transcendental register of universalist humanity and right contemporary imaginations of justice deliriously describe, this paper triangulates between contract, free will, and the slave to consider how the time of slavery persists in and as the exchange protocols encoded on blockchain platforms. The stakes here concern a need to track the deep continuity of anti-Blackness, white supremacy and their associated legal constructs as they replicate within the “extra-legal” field of digital exchange protocols, before ending with a challenge to the grammar of credit, labor and right the slave’s emancipation is always forced to rhetorically work through.RÉSUMÉ:Cet article pose la question suivante : comment les contrats intelligents résolvent-ils la relation étroite entre liberté et captivité exprimée dans un contrat ? Contrairement au registre transcendental et universaliste de l’humanité et du droit décrit par les fictions contemporaines délirantes de la justice, cet article met en rapport les notions de contrat et de libre arbitre avec la figure de l’esclave, afin de réfléchir à la persistance de l’esclavage sous la forme de protocoles d’échange chiffrés dans les chaines de blocs. L’enjeu, ici, est la nécessité de suivre la profonde continuité de la suprématie blanche et antinoire, et de ses constructions juridiques telles qu’elles se reproduisent dans le domaine « extrajuridique » des protocoles d’échange numériques. Nous concluons sur un défi lancé à la grammaire du crédit, du travail et des droits à laquelle l’émancipation de l’esclave est toujours forcée de se plier rhétoriquement.
