Realitas Partisipasi Publik dalam Proses Legislasi di tengah Pandemi: Overview dalam Perspektif Pemenuhan HAM

In the last two years, the pandemic has restricted various public activities. However, the DPR and the Government took advantage of this moment of limitation on community activities to discuss and pass several important laws that affect many people's lives in a non-participatory process. The Employment Creation Act and the Minerva Law are the reality of how the legislators ignore the fundamental right of the community to participate in the formation of the law. This study elaborates on the fact that the legislators in carrying out pseudo-procedural participation and not substantive. The process of drafting the two laws is reviewed and compared to show how the pandemic has become an opportunity to violate people's rights. This study also examines the conception and application of substantial participation in providing protection and guarantees for fulfilling human rights in the legislative process. The digital era increasingly developing in the future is expected to be an opportunity to realize meaningful participation in the formation of laws in Indonesia.
