The Prima Facie Requirement in Procedures for Granting Interim Measures Before the Court of Justice of the European Union
This article analyzes the powers of the Court of Justice of the European Union to evaluate the prima facie case in the course of proceedings under Articles 278 and 279 of the TFEU when granting interim measures. It examines the CJEU’s case law to determine what “prima facie” means in the context of the prohibition to prejudge the main case.
