The profiles of the two judgements that are investigated are three, and namely: the timing of the procedures, the role of discrimination in the assessment of violations of the TFEU rules on the freedom of movement of capital and services, the assessment of violations of the Charter of Fundamental Rights of the European Union alongside TFEU violations. 摘要

本文分析了欧洲法院去年对匈牙利作出的两项裁决,目的是概述法院判例法中的一种新趋势,即面对对法治的威胁而没有明确提及它。所调查的两项判决的概况有三个,即:程序的时机、歧视在评估违反《欧盟基本权利宪章》关于资本和服务流动自由的规则方面的作用、评估违反《欧盟基本权利宪章》的情况以及违反《欧盟基本权利宪章》的情况。该条的目的是要证明,即使一个案件被设计为纯粹技术性的,没有诉诸法治,也可以成功地利用《公约》第258条规定的侵权程序来阻止反民主的倾向和不自由的趋势,这可能最终使法院本身免于被指控过于政治地介入会员国的事务。
